In a residential estate in Tuen Mun, the flat owner suffered from water leakage from the upper floor, resulting in spalling of concrete on the bathroom and kitchen ceilings. After contacting the property management office and the Food and Environmental Hygiene Department, there was no significant progress due to the lack of cooperation from the upstairs owner.

The owner then decided to use the company’s inspection services. Using an elimination approach with testing instruments, the company’s staff conducted investigations only from the lower flat and issued a report signed by a Registered Surveyor. The owner submitted this report to the Small Claims Tribunal to lodge a claim. As the upper-floor owner failed to provide any evidence or recognised report in defence, the court ruled against the upper-floor owner, who was ordered to compensate the claimant for the company’s testing fee, the repair costs and other related expenses.

In a unit in Mong Kok, the living room, bathroom, kitchen and corridor were all affected by seepage, with exposed reinforcement visible on the living room wall and structural safety already at risk.

The company submitted an inspection report together with a loss assessment report, and the client, with support from the team, negotiated and pursued compensation from the upper-floor owner. Eventually, the affected owner successfully obtained compensation and secured an undertaking from the upper-floor owner to carry out repairs and provide maintenance within a specified period.
